“The False Claims Act has increasingly become a hot button issue in government contracting. Whistleblowers continue to find avenues and incentives to bring claims, and various amendments to the Act and court decisions over the years have widened the scope of potential liability. This presentation will highlight three main areas: (1) the history and background of the False Claims Act, (2) a detailed exploration of the current statutory scheme, and (3) recent developments and current litigation, including the “implied certification” doctrine addressed by the Supreme Court in the Escobar case.”
