Eckland & Blando won a massive victory against a litigant seeking to improperly use the Endangered Species Act to shut down our client’s operations along the East Coast. In Strahan v. Cosco Container Lines, Amerika Inc., et al., 22-cv-10722-DOJ, 2023 WL 3457905 (D. Mass May 15, 2023), we won a Fed. R. Civ. P. 12(c) Judgment on the Pleadings, with the District Judge finding plaintiff lacked standing and that his ESA claims were entirely implausible. The ESA is an important tool but, as our recent win shows, it cannot be improperly used to target an innocent company.
