Marshall B. Kelner

Marshall concentrates his practice on litigation, with a focus on employment, commercial, and sports-related disputes. He brings a collaborative, detail-driven approach to every matter, focused on practical solutions and strong client relationships.

Marshall works with both employers and employees on a wide range of issues, including non-compete and non-solicitation agreements, discrimination and wrongful termination claims, issues surrounding DEI policies, wage and hour disputes, and family and medical leave. He is a strong advocate and will litigate aggressively when necessary, but will always attempt to resolve the dispute without litigation when possible. He also enjoys counseling employers on new laws and how best to comply with them to avoid potential litigation in the future. In addition, he conducts highly-sensitive (and sometimes high-profile) employment investigations to help organizations navigate challenging situations in the workplace and get to the bottom of what happened.

On the sports front, Marshall has worked with major organizations on eligibility issues, NIL rights, sports gambling policies, and regulatory compliance, as well as more general litigation matters involving employee privacy, contract disputes, and financial services litigation.

Marshall graduated magna cum laude from the University of St. Thomas School of Law. While there, he served as Symposium Editor of the Law Journal, his team reached the semi-finals of the Tulane International Baseball Arbitration Competition, and he successfully completed the Federal Commutations Clinic. He was also President of the student chapter of the Federalist Society and the Sports, Entertainment, and Media Law Society.

Prior to law school, Marshall was behind the mic as a play-by-play broadcaster in Minor League Baseball, including a stint with the Minnesota Twins’ affiliate in Fort Myers, FL. Outside of work, he enjoys spending time with friends and family, traveling, trying new restaurants, and rooting for Minnesota and USC sports teams.
